A deduction from earnings order can be issued administratively by the CSA without going through a Court, or indeed without any kind of Justice or judicial mechanism. The CSA claims to be non-sexist and claims to show no gender bias at all while issuing 70.000 Orders against men per annum and has issues a total of 19 against women. That is clearly well-balanced so we don't need a proper Judge to be involved at all. The criteria the CSA use to issue a DEO is not widely known, so I reproduce it here:

So the criteria are:

  • Not paying for 2 months
  • Refusal to pay
  • Not being able to reach an agreement
The CSA will also try to introduce other spurious criteria like "not being cooperative", but these and other "reasons" are not legal and should be challenged. By being so fuzzy, the third criteria is a catch-all; for example if your ex-wife is a stroppy cow and simply refuses your offers of money (no matter how generous you are) then agreement has not been reached and an Order will be issued against you.

Once an Order has been issued it is near impossible to get it removed. After issue you have a few days to challenge it at Magistrates Court but firstly there is a fee (around £170) to go to Magistrates court, secondly they can only find it invalid if there is a technical mistake in it, and thirdly the CSA will simply rectify their mistake (no word of thanks!) and re-issue an Order which does not have any technical errors in.
